Relaunching course bypasses the attempt limiting in course; storyline, scorm, scorm cloud

Hello!
Courses we create typically have activities and an attempt-limited final exam (3 tries). Typically speaking this works great - we've even built in a retake code that allows a learner the opportunity to try again past the 3 tries.
The problem we are seeing now, is when a person who has exceeded their attempts exits the course and relaunches it (scorm cloud hosted), the LMS doesn't forget that they have made progress, but it does not take them to the Failure slide (and layer). Instead, it will restart them at the beginning of the final exam, effectively giving them a free, and unlimited, retry.

I've seen some solutions involving a locked pop-over layer based on # of attempts, and blocks access to the materials beneath, but I'd really like to know why the user isn't being taken directly to the failure slide layer that they were on previously.

If the user stops anywhere in the course content and exits and restarts, it will take them to the appropriate location.

It sounds like the issue is specific to an LMS setting, but we'd be happy to take a look at the .story file to see if there may be a culprit within the project.

Just as a follow up, in case anyone came across this issue - it wound up being an issue with suspend data limits in SCORM v1.2. Luckily we were able to bypass a requirement in our LMS by hosting through SCORM Cloud and using dispatches and moving to SCORM 2004 which allows for a lot more.
