Why don't I have a pass/fail option?
When I try to publish for the LMS I have one course that allows me to publish with the passed/failed setting. I duplicated that exact course to edit the language, but now, I only have the Passed/Inc...

You'll only see the Passed/Failed and Completed/Failed options if you're tracking a course by a quiz. When you duplicate a course, the duplicate defaults to tracking by course completion, which can explain the difference in options if you edit and go straight to publishing.
