Declaration and quiz requirement in compliance course

I have designed a compliance course in Presenter and Quizmaker 13 that requires the learner to complete some content, then agree to a disclaimer that they have read a policy, then complete 10 assessment questions and achieve 80%.
At first I thought I could use the group feature in Quizmaker to make the declaration 100% or fail (group 1), and the remaining 20 assessment questions (of which 10 are included) set at 80%. I would force the learner not to continue past group1 if they did not tick yes to the declaration, thereby meaning the learner was unable to pass the course. However, when I went to set the pass mark in options, the options appears to be universal for both groups of questions/
I understand I could create 2 quizzes in the course (one as the declaration and one as the assessment), but I think I can only select 1 quiz as the 'track by assessment' quiz when publishing, so I dismissed this as an option.
Is there a way to achieve this design requirement?
Or, do I have to make the overall pass mark 100%, to incorporate the declaration requirement?

Hi Alison!
What about setting up that question to where the learner cannot proceed without accepting.
You can give feedback by choice so that they understand what is going on and allow unlimited attempts so that they cannot go past this question until answered appropriately.
