The button only seems to be visible on the base layer. when i move it to another layer (so it appears above to movie) it wont show when previewing the slide.
The reason your button is dissappearing is because you are not embedding teh movie, you are inserting teh movie as a web object. Web Objects will always be in front of anything else.
Embedding the movie will allow other items to be placed in front of them.
I have attached an example story where the fake playbar opens three different layers in front of the video and the layer close buttons are also in front of theose videos.

Create a layer with the movie on it and use the show layer trigger.

It *could* also make a difference how the Flash movie is inserted (as Flash or as Video) - http://community.articulate.com/tutorials/products/adding-flash-files.aspx

I've managed to get the movie to play by clicking the button.
I had to add a trigger to the button to "show layer", then added the layer at this stage. i then added the movie to this layer.
Problem I have now is I want the button layer to be above the movie layer?
Can anyone help with this?

I would put the play button on your base slide layer... There are some good tips here on how to control visibility of base layer objects on other slide layers - http://community.articulate.com/tutorials/products/adding-and-editing-slide-layers.aspx
