Published content using Content Library assets

Oct 19, 2018

All,

I'm using Storyline 360 to update an e-learning course.  I've downloaded a template and images from the content library to use in making those updates.  The course is intended to be published and accessible for viewing via an intranet site for our employees.

I reviewed the Terms of Use and noted the following:

2. Articulate Content and User Content
The Site contains content owned or licensed by Articulate ("Articulate Content"). Articulate Content is protected by copyright, trademark, patent, trade secret and other laws, and, as between you and Articulate, Articulate owns and retains all rights in the Articulate Content and the Site. There are two types of User Content: (a) downloadable assets, and (b) articles.

(a) Downloadable Assets. An example of a downloadable asset is a PowerPoint template that Articulate provides. You will have a limited, nonexclusive, nontransferable, terminable right to use, reproduce, display, and distribute downloadable assets in a commercial work (including the right to showcase it as part of your portfolio). All other rights are reserved. Accordingly, you may not distribute, modify, or host downloadable assets as your own content (or permit any third party to do so).

My questions:

1.  Is it acceptable under the Terms of Use to brand the course with our company name/logos without attribution to Articulate in the published course?

2.   If the answer to question 1 is no, does that mean that in order to develop e-learning content using Storyline 360 that is intended for our employee use, we must only use slides and other content that is developed internally or licensed separately by our company (i.e. no templates or content library images)?

Thank you,

Mary

Hi Mary,

Those are the terms of using our website, but you'll want to take a look at the Terms of service for using Articulate 360 here, specifically section 2.11:

  • 2.11. Content Files. "Content Files" means Articulate-provided files such as character images and illustrations, templates, interactions or other pre-built content as part of the Services. Unless the documentation or specific license associated with the Content Files states otherwise, you may use, display, modify, reproduce, and distribute any of the Content Files as part of the Services. However, you may not distribute the Content Files on a stand-alone basis.

Hi Marcia,

Images from the Content Library are part of the Terms of Service Ashley described above, and you may use the content in connection to any Articulate 360 apps. They can’t be used on a stand-alone basis, or outside the scope of your e-learning production.

As long as the job aids/blended learning is in direct reference to courses built using Articulate apps, you should be ok!
