Copyright Usage and Embedding Videos

I am interested in embedding videos from YouTube and from HBR into my Storyline courses.

  1. First: is there any clear documentation, not conjecture, about whether this violates copyright law because it is technically creating a new product? We are not distributing external or selling the content. It is for internal purposes, only. 
  2. Secondly, if it is legal, does it become prohibited if  I use a paid contractor to develop the content for us?
  3. Third, TED Talks have user agreements listed on their website. Which takes precedence? The TED ToS or the Youtube ToS?

Hi Jenn,

You cannot embed TED talks in a corporate environment without getting permission from them. Their usage policy has a link to a request form you could fill out. As for other YouTube videos, you also cannot use them without the creator's permission. This would be true if you made the videos or someone else did. However, some video creators may have made the video available under a creative commons license, in which case permission has already been granted.
