Articulate 09, built custom skin having trouble with slides when user closes course and returns

I know this is an old application but i have been working on a custom skin for my company using it.
My issue is i made a custom menu where the visited slides change to a dark grey while the unvisted are light grey. This works fine as you are taking the course on our LMS, but if you close the course before completing and open it again (with the setting turned on to resume where user left off) it will return you to the correct slide. But all previous slides that were viewed are back to light grey(unvisited state) except for slide number 1 and the slide you left off on(which are the dark grey visited state).
The user doesnt have to review all the previous slides. That data is stored correctly on LMS.
I have looked all through the 09 sdk and cannot find any reference to this. Can anyone tell me if there is a way to do this or if it is even possible?
Just some extra info, the buttons in the menu have 3 states in a movie clip: hover, not visited, and visited.

Can you explain what you mean by "custom menu"? Do you mean that you changed the player colors, or did you actually create your own buttons, etc. on a slide that acts as a menu?
Could you provide us with a screenshot of what you're seeing before closing the course and then once you resume it?

I actually created the menu in flash using the sdk kit and then once published i turn it into an install for articulate 09. So the menu is actually part of the interface. I am attaching an image of when i first open course and one when i close and reopen.
