In my course we have 10 slides of content, after that 5 questions in a quiz.
If the student left the course in slide 2, 3, 5 (for example) some times the scorm is checked like failed. The student don't beguin the test.... and is failed
Could you put in an instruction that if they leave the course before attempting the quiz - they will be marked as Fail? 10 slides - not like it is a really long module where they need to take a break?

How do you have the Reporting/Tracking set when published? This blog may share some insight as well.
Tracking > Track using quiz result
But if you close the Scorm without made the quiz, report failed

Sounds as if this would be the expected behavior. Your user is not making your pass percentage of the quiz requirement you have set, which is a fail.
